    RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
    East Thonotosassa Baptist church Antioch Days “WHEELS OF ANTIOCH” Car Show/ Festival event

    IN CONSIDERATION OF PARTICIPATING IN East Thonotosassa’s Antioch days “WHEELS OF ANTIOCH” Car Show event, spectate, officiate, observe, work, or PARTICIPATE in any way IN THE ABOVE EVENT. EACH OF THE UNDERSIGNED, FOR HIMSELF OR HERSELF, HIS OR HER PERSONAL REPRESENTATIVES, HEIRS, NEXT-OF-KIN:

    1. ACKNOWLEDGES, AGREES AND REPRESENTS THAT HE OR SHE HAS OR WILL immediately upon entering ETBC “Wheels of Antioch” area, and will continuously thereafter, INSPECT ETBC “Wheels of Antioch” area which he or she enters, and he or she further agrees and warrants that, IF AT ANY TIME, he or she is in or about the ETBC “Wheels of Antioch” area and HE OR SHE FEELS ANYTHING TO BE UNSAFE, HE OR SHE WILL IMMEDIATELY ADVISE THE OFFICIALS OF SUCH and if necessary will leave the ETBC “Wheels of Antioch” area AND REFUSE TO PARTICIPATE FURTHER IN THE EVENT(S).

    2. HEREBY RELEASES, TO THE FULLEST EXTENT PERMITTED BY LAW, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE, East Thonotosassa Baptist Church/The Church of Antioch, Its personnel, employees & staff, volunteers, participants, advertisers, sponsors, owners and lessees of premises used to conduct the Event(s), premises and event inspectors, consultants and others who give recommendations, directions or instructions or engage in risk evaluation or loss control activities regarding the premises or Event(s) and each of them, their councils, directors, officers, agents, employees, and volunteers all for the purposes HEREIN REFERRED TO AS “RELEASEES,” FROM ALL LIABILITY TO THE UNDERSIGNED, HIS PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, AND NEXT-OF-KIN FOR ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY ARISING OUT OF OR RELATED TO THE EVENT(S) WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.; especially On the properties of East Thonotosassa Baptist Church.

    3. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES AND EACH OF THEM FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or RELATED TO THE UNDERSIGNED’S INJURY WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

    4. HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK, KNOWN AND UNKNOWN, OF VEHICLE INJURY, PERMANENT VEHICLE DISABILITY, arising out of or related to the Event(s), INCLUDING MAINTENANCE, RESTORATION, OR PROPERTY DAMAGE arising out of or related to the Event(s) whether CAUSED BY THE NEGLIGENCE OF RELEASEES or PARTICIPANTS, SPECTATORS, or otherwise.

    5. HEREBY ACKNOWLEDGES THAT THE ACTIVITIES OF THE EVENT(S) can be DANGEROUS and involve the risk of serious injury and/or property damage. Each of THE UNDERSIGNED, ALSO EXPRESSLY ACKNOWLEDGES THAT INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT PARTIES OR PROCEDURES OF THE RELEASEES.

    6. HEREBY AGREES THAT THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT EXTENDS TO ALL ACTS OF NEGLIGENCE BY THE RELEASEES, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is permitted by the laws of the State of Florida and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

    Because East Thonotosassa Baptist Church (hereafter “ETBC”), is open for use by other individuals, I recognize that I may be at risk of contracting COVID-19. With full awareness and appreciation of the risks involved, I, for myself and on behalf of my child, family, spouse, heirs, and/or on behalf of my assigns, and estate, forever release, waive, and agree not to sue ETBC, its members, agents, affiliates, employees, visitors, and volunteers from any and all liability, claims, demands, or legal actions, either directly or indirectly related to any loss, damage, injury, or death, that may be sustained by me as result of negligence, COVID-19 or otherwise, while participating in any activity, and/or while using any ETBC facilities, tools, equipment, or materials.

    7. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages to my personal property and or products as a vendor, claims, lawsuits, judgments, losses, and/or arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to injury, death, or any other related to my use of the ETBC facilities, tools, equipment, or materials.


    I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND BY CHECKING THE AGREE BOX BELOW ACT AS MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. CAUTION THIS IS A RELEASE OF LEGAL RIGHTS -READ AND UNDERSTAND BEFORE TYPING YOUR NAME (WHICH WILL ACT AS YOUR SIGNATURE AND SIGNING YOU AGREE TO THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
